These Terms govern your use of CityWalkGems, operated by Pura Vida B.V. ("we", "us", "our"), a company registered in the Netherlands. By using the app or website, you enter into a contract with Pura Vida B.V.
1. Acceptance
By accessing or using CityWalkGems, you agree to be bound by these Terms. If you do not agree, do not use the service. You must be of legal age in your country, or have parental consent.
2. The Service
CityWalkGems provides location-based interactive city tours, puzzles, and stories. Tours are delivered through our mobile-web app. Content and availability may change at any time.
3. Accounts
You are responsible for safeguarding your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.
4. Acceptable Use
You may not: (a) use the service for any unlawful purpose; (b) commit fraud or send spam; (c) infringe intellectual property or privacy rights; (d) interfere with the security or integrity of the service (including malware, scraping, probing, or reverse engineering); (e) resell or redistribute access without our written consent.
5. Payments and Subscriptions
Paid tours, city passes, and subscriptions are sold through our reseller Paddle.com. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Pricing, billing frequency, taxes, renewals, payment terms, cancellations, and refunds are governed by the Paddle Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms) and our Refund Policy. Subscriptions renew automatically until cancelled.

7. Intellectual Property
All tours, stories, puzzles, designs, software, branding, and content are the exclusive property of Pura Vida B.V. or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the service for personal, non-commercial purposes within your purchased plan. All other rights are reserved.
8. User Content
If you submit feedback, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free license to host and process that content solely to provide and improve the service.
9. Safety
CityWalkGems is a real-world outdoor activity. You are solely responsible for your own safety. Stay aware of traffic, your surroundings, weather, and local laws. Do not use the app while driving. Respect private property.
10. Service Availability
The service is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.
11. Liability
To the fullest extent permitted by law, Pura Vida B.V. is not liable for any personal injury, property damage, or loss arising from your use of the service. Our aggregate liability for any claim is limited to the fees you paid us in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence where such exclusion is prohibited by law.
12. Indemnity
You agree to indemnify and hold Pura Vida B.V. harmless from claims arising from your user content, your breach of these Terms, or your unlawful use of the service.
13. Suspension and Termination
We may suspend or terminate your access at any time for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious violations of acceptable use. You may stop using the service at any time. On termination, your right to use the service ends; sections that by their nature survive (IP, liability, indemnity) remain in effect.
14. Privacy
Our handling of personal data is described in our Privacy Notice at /privacy.
15. Changes
We may update these Terms from time to time. Material changes will be communicated through the app or by email. Continued use after changes take effect constitutes acceptance.
16. Governing Law and Disputes
These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent courts of the Netherlands, without prejudice to mandatory consumer protections of your country of residence.
